£5000 Awarded in Trip Claim

Malcolm Horner, Head of the Personal Injury department, recently acted for a client who was injured whilst crossing road in Southampton in 2015. Where the grass verge met the road, there was a gully which had developed over a number of years. This gully caused her to trip and injure her leg.

She commenced a claim against the council who denied responsibility, instead placing the blame on their sub contractors. However, when Court proceedings were commenced, they then finally accepted responsibility themselves and settled the claim, notwithstanding the contractual document seemed to suggest that Balfour Beatty were responsible due to our aggressive argument that it was one of them who was responsible and they should sort it out between them, because this was not our clients concern. Malcolm obtained an award in excess of £5,000 for our client.
