Accident at Work – A Case Study
Malcolm Horner, head of personal injury, recently acted for a 58 year old man who was injured at work. An award of over £500,000 was achieved.
He and a colleague were instructed to carry a heavy radiator. Unfortunately his colleague lost his grip and let go. The full force of the radiator fell onto the claimants hip area and fractured the same causing internal injuries as well. Malcolm was able to prove that this was an unsafe system of work.
He is left with a permanent stoma as well as serious orthopaedic injuries. The case was settled after several medico-legal examinations and re-examinations. The defendants asserting that he would be able to get back to work and did not need much care and assistance. The settlement was achieved at a joint settlement meeting just over 3 years post accident. After a long day of negotiations a settlement was reached which the client.
