If an individual owes more than £5,000 and the debt is not disputed, you may petition the Court for their bankruptcy. Before doing so, a statutory demand must be served on the individual personally. Of course, the aim of bankruptcy is not to make the individual bankrupt but to be paid the monies you are owed. It is an effective method of debt recovery.

We also advise individuals who face bankruptcy proceedings and advise them on if and how their bankruptcy can be avoided.

Where an individual is unable to pay their debts, they may petition the Court for their own bankruptcy. We provide a fixed fee service for obtaining a bankruptcy order and assisting with enquiries of the Official Receiver, once the Bankruptcy Order has been obtained.
